2027 Marketplace tax credit changes for immigrants: who still qualifies

Starting with 2027 coverage, the premium tax credit is limited to green card holders and a few other groups. Who is affected, and what options remain.

A federal law passed in July 2025 changes who can get help paying for Marketplace coverage. Starting with plan year 2027, the premium tax credit and cost-sharing reductions are limited to a narrower group of immigrants. Here is what changed, based on CMS guidance.

Who can still get the tax credit in 2027

Besides U.S. citizens, the tax credit remains available to:

  • Lawful permanent residents (green card holders);
  • Cuban and Haitian entrants;
  • people lawfully residing in the U.S. under a Compact of Free Association (COFA).

Who is affected

Other lawfully present immigrants — for example, people with many types of visas or other statuses — can still buy a Marketplace plan for 2027, but they will no longer receive the premium tax credit or cost-sharing reductions and will pay the full premium.

If you're enrolled now and fall into this group, HealthCare.gov will redetermine your eligibility for 2027. You may be asked to submit documents.

What you can do

  • Check your status early. Open Enrollment starts November 1, 2026. Knowing whether you qualify for the credit changes which plan makes sense.
  • Compare the full-price options. Without a credit, a plan with a higher deductible and lower premium may be the realistic choice. Look at the out-of-pocket maximum too.
  • Report changes. If your immigration status changes during the year — for example, you receive a green card — you may become eligible for the credit.
